Note: These Terms & Conditions are governed by Spanish law. The legally binding version is in Spanish. The English version is provided for information purposes only. In case of discrepancy, the Spanish version prevails.
These General Terms and Conditions (hereinafter, "the Terms") govern the contractual relationship between Seaesta Seaempre S.L. (hereinafter, "Seaesta" or "the Lessor") and the natural or legal person completing a booking (hereinafter, "the Renter"), under which Seaesta grants the Renter temporary use of a recreational vessel, in accordance with Spanish Maritime Navigation Law 14/2014, Royal Legislative Decree 1/2007 (Consumer Protection Act) and other applicable regulations.
Las presentes Condiciones Generales de Contratación (en adelante, «las Condiciones») regulan la relación contractual entre Seaesta Seaempre S.L. (en adelante, «Seaesta» o «el Arrendador») y la persona física o jurídica que formaliza una reserva (en adelante, «el Arrendatario»), en virtud de la cual Seaesta cede al Arrendatario el uso temporal de una embarcación de recreo, de conformidad con la Ley 14/2014, de 24 de julio, de Navegación Marítima, el Real Decreto Legislativo 1/2007 (Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios) y demás normativa aplicable.

By completing the booking process, the Renter declares having read, understood and fully accepted these Terms, which are legally binding. Seaesta reserves the right to modify these Terms at any time; updated versions will be published on the website and will apply to bookings made after their publication.

Seaesta se reserva el derecho de modificar estas Condiciones en cualquier momento; las versiones actualizadas serán publicadas en el sitio web y se aplicarán a las reservas formalizadas con posterioridad a su publicación.
These Terms apply both to bookings made directly on seaestaboats.com and to those made through third-party platforms (GetYourGuide, Click&Boat or others), with Seaesta's operational conditions being binding in all cases once the booking is confirmed.
Estas Condiciones aplican tanto a las reservas realizadas directamente en seaestaboats.com como a las efectuadas a través de plataformas de terceros (GetYourGuide, Click&Boat u otras), siendo las condiciones operativas de Seaesta vinculantes en todos los casos una vez confirmada la reserva.
The following requirements must be met to complete a rental with Seaesta:

- The Renter must be at least 18 years old and have full legal capacity to contract.El Arrendatario debe ser mayor de 18 años y tener plena capacidad jurídica para contratar.
- The designated driver(s) must be at least 18 years old and present a valid official identity document (national ID, NIE or passport). The driver's identity must be verified before the rental begins, both via the pre-boarding form and by presenting the original document at Port Fòrum.El conductor o conductores designados deben ser mayores de 18 años y presentar un documento de identidad oficial válido en vigor (DNI, NIE o pasaporte). Se deberá acreditar la identidad del conductor antes del inicio del alquiler, tanto mediante el formulario previo al embarque como con la presentación del documento original en Port Fòrum.
- The Barqa Q17 vessels (4.99 m, 15 HP Suzuki engine) do not require a nautical licence, in accordance with Royal Decree 875/2014. However, the driver must complete and pass the mandatory safety briefing before departure.Las embarcaciones Barqa Q17 (4,99 m, motor 15 CV Suzuki) no requieren titulación náutica, de conformidad con el Real Decreto 875/2014 (Art. 10) sobre titulaciones náuticas. No obstante, el conductor deberá realizar y superar el briefing de seguridad obligatorio antes de zarpar.
- The maximum capacity is 5 persons on board, including driver(s) and passengers. Exceeding this limit constitutes a serious breach and grounds for immediate termination of the contract.La capacidad máxima es de 5 personas a bordo, incluyendo conductor(es) y pasajeros. Superar este límite constituye infracción grave y motivo de resolución inmediata del contrato.
- Vessels are collected and returned at Seaesta's facilities at Port Fòrum, Barcelona. Return at any other point is not permitted without prior written agreement.Las embarcaciones se recogen y devuelven en las instalaciones de Seaesta en Port Fòrum, Barcelona. No se permite la devolución en otro punto salvo acuerdo escrito previo.
- Only persons registered on the boarding form may use the vessel. Assignment, sub-letting or use by unregistered persons is expressly prohibited.Únicamente podrán usar la embarcación las personas registradas en el formulario de embarque. Queda expresamente prohibida la cesión, subarriendo o uso por personas no registradas.
Departures begin from 07:30. The specific start and end times for each rental are those indicated in the booking confirmation. The Renter must return the vessel by the booked end time. Late returns will be charged per commenced hour at the hourly rate of the booked package, calculated on the standard package price (not on any discounted or promotional price paid), and deducted from the security deposit.
Las salidas comienzan a partir de las 07:30 h. Los horarios concretos de inicio y fin de cada alquiler son los indicados en la confirmación de reserva. El Arrendatario debe devolver la embarcación al finalizar su franja horaria reservada. Los retrasos en la devolución se cobrarán por cada hora iniciada a la tarifa horaria del paquete reservado, calculada sobre el precio estándar del paquete (no sobre el precio con descuento o promocional abonado), y se deducirán del depósito de seguridad.
The Renter receives the vessel in correct working order, clean and with a full fuel tank. Any deficiency observed at handover must be reported to Seaesta staff before departure and noted in writing.
El Arrendatario recibe la embarcación en correcto estado de funcionamiento, limpia y con el depósito de combustible lleno. Cualquier deficiencia observada en el momento de la entrega deberá comunicarse al personal de Seaesta antes de zarpar y quedar reflejada por escrito.
Minors on board are permitted only under the following conditions:
Se permite la presencia de menores de edad a bordo únicamente bajo las siguientes condiciones:
- Minors must be accompanied at all times by their parent or legal guardian, who will be responsible for their safety throughout the rental.Los menores deben ir acompañados en todo momento por su padre, madre o tutor legal, quien será responsable de su seguridad durante toda la duración del alquiler.
- The parent or legal guardian who signs the rental contract and boarding form assumes full responsibility for the minors in their care, including compliance with safety rules and correct use of life jackets.El padre, madre o tutor legal que firme el contrato de alquiler y el formulario previo al embarque asume plena responsabilidad por los menores a su cargo, incluyendo el cumplimiento de las normas de seguridad y el uso correcto de los chalecos salvavidas.
- Seaesta reserves the right to refuse boarding if, in the judgement of staff present, the safety of minors on board cannot be guaranteed (adverse weather, group behaviour, excessive number of persons, etc.).Seaesta se reserva el derecho de denegar el embarque si, a criterio del personal presente, la seguridad de los menores a bordo no puede garantizarse (condiciones meteorológicas adversas, comportamiento del grupo, número excesivo de personas, etc.).
- Children under 14 must wear an approved life jacket at all times while the vessel is in motion. Seaesta has children's life jackets available upon prior request.Los menores de 14 años deben llevar chaleco salvavidas homologado en todo momento mientras la embarcación esté en movimiento. Seaesta dispone de chalecos infantiles bajo solicitud previa.
- For capacity purposes, minors count as a full person. The 5-person limit includes minors without exception.A efectos del cómputo de capacidad, los menores cuentan como una persona completa. El límite de 5 personas incluye a los menores sin excepción.

If travelling with minors, please mention this when booking. Seaesta will prepare appropriate safety equipment (children's life jackets) and the briefing will include specific instructions.

The Renter undertakes to use the vessel diligently and responsibly, respecting maritime traffic regulations at all times. The following are expressly prohibited:
El Arrendatario se compromete a utilizar la embarcación de forma diligente y responsable, respetando en todo momento la normativa de tráfico marítimo vigente. Queda expresamente prohibido:
- Operating under the influence of alcohol, drugs or any other substance that impairs consciousness, reflexes or responsiveness, or navigating in a state of drowsiness or fatigue that poses a risk to the driver, passengers or third parties.Navegar bajo los efectos del alcohol, drogas u otras sustancias que alteren el estado de consciencia o los reflejos, o en estados de somnolencia o fatiga que pongan en peligro la integridad propia, de los pasajeros o de terceros.
- Negligent or reckless navigation that endangers the driver, passengers or third parties.Conducir de forma negligente, temeraria o que ponga en peligro la integridad propia, de los pasajeros o de terceros.
- Exceeding the authorised navigation zones indicated in the briefing, going beyond established limits, or navigating in adverse weather conditions or during an active alert. Navigating outside the authorised zone shown on the navigation map carries a fixed penalty of €100, deducted from the security deposit (see clause 07).Superar las zonas de navegación autorizadas indicadas en el briefing, alejarse más allá de los límites establecidos o navegar en condiciones meteorológicas adversas o con alerta activa. - Using the vessel to push or tow other vehicles, practising high-risk sports not authorised by Seaesta, or participating in any race or competition.Usar la embarcación para empujar, remolcar otros vehículos, practicar actividades deportivas de alto riesgo no autorizadas por Seaesta, o participar en cualquier tipo de prueba o competición.
- Modifying, tampering with or attempting to repair the vessel, engine or any equipment without Seaesta's express authorisation.Modificar, manipular o intentar reparar la embarcación, el motor o cualquier equipo sin autorización expresa de Seaesta.
- Mooring the vessel in an undesignated location without prior notice to Seaesta.Amarrar la embarcación en un lugar no designado sin comunicarlo previamente a Seaesta.
- Assigning, sub-letting or allowing use of the vessel by persons not registered on the boarding form.Ceder, subarrendar o permitir el uso de la embarcación a personas no registradas en el formulario de embarque.
- Exceeding the maximum capacity of 5 persons on board.Superar la capacidad máxima de 5 personas a bordo.
- The possession or use of illegal substances, narcotics, weapons or any item prohibited under Spanish law on board is strictly forbidden for all persons, regardless of their role.Queda estrictamente prohibido para todas las personas a bordo, con independencia de su función, portar o consumir sustancias ilegales, estupefacientes, armas o cualquier objeto prohibido por la legislación española.
Consequences of breach:Consecuencias del incumplimiento:
Breach of any of the above prohibitions may result in immediate termination of the contract without refund, full retention of the security deposit, and the Renter's civil liability for all damages caused, including any resulting administrative penalties.
La infracción de cualquiera de las prohibiciones anteriores podrá conllevar la resolución inmediata del contrato sin derecho a reembolso del importe pagado, la retención íntegra del depósito de garantía, y la responsabilidad civil del Arrendatario por todos los daños y perjuicios ocasionados, incluidas las sanciones administrativas derivadas.
Seaesta staff will conduct a mandatory safety briefing before each departure. The Renter will confirm their understanding of the instructions received by signing the boarding form. Departure will not be authorised without completion and signature of the briefing.
El personal de Seaesta realizará un briefing de seguridad obligatorio antes de cada salida. El Arrendatario confirmará su comprensión de las instrucciones recibidas mediante firma del formulario de embarque. Sin la realización y firma del briefing, no se autorizará la salida.
Pets on board:Mascotas a bordo:
Pets are welcome on board. The Renter is responsible for keeping them safe and under control at all times and for cleaning up after them.
Las mascotas son bienvenidas a bordo. El Arrendatario es responsable de mantenerlas seguras, bajo control en todo momento y de recoger sus necesidades.
Night navigation:Navegación nocturna:
Under Spanish maritime law (Real Decreto 875/2014), vessels of this category are not permitted to navigate after sunset. Seaesta sets all package end times to ensure return to port before sunset. The Renter must respect the booked end time. Any fines or sanctions imposed by maritime or port authorities due to navigation after sunset are the exclusive responsibility of the Renter.
Conforme a la legislación marítima española (Real Decreto 875/2014), las embarcaciones de esta categoría no están autorizadas a navegar después del ocaso. Seaesta establece los horarios de fin de cada paquete para garantizar el regreso al puerto antes del ocaso. El Arrendatario debe respetar la hora de finalización reservada. Cualquier multa o sanción impuesta por las autoridades marítimas o portuarias por navegar después del ocaso es responsabilidad exclusiva del Arrendatario.
Bookings are made exclusively online through seaestaboats.com or authorised distribution platforms (GetYourGuide, Click&Boat or others listed on the website), subject to real-time availability.
Las reservas se realizan exclusivamente online a través del sitio web seaestaboats.com o de las plataformas de distribución autorizadas (GetYourGuide, Click&Boat u otras indicadas en el sitio web), sujetas a disponibilidad en tiempo real.
Payment for direct bookings is processed by Stripe Payments Europe Ltd, a PCI-DSS Level 1 certified payment platform. Seaesta does not store or have access to full card details at any time.
El proceso de pago para reservas directas está gestionado a través de Stripe Payments Europe Ltd, plataforma de pagos certificada PCI-DSS Nivel 1. Seaesta no almacena ni tiene acceso a los datos completos de tarjetas bancarias en ningún momento.
The full rental amount is charged at the time of booking. No rental payment is due at boarding, without prejudice to the security deposit (see section 07).
El importe total del alquiler se abona íntegramente en el momento de la reserva. No existe pago pendiente en el momento del embarque por concepto de alquiler, sin perjuicio del depósito de garantía (véase sección 07).
All published prices include applicable VAT (21%) and basic third-party liability insurance for the vessel. Fuel is included in the rental price: the vessel is handed over with a full tank and the Renter must not refuel at any point during the rental period.
Todos los precios publicados incluyen el IVA aplicable (21%) y la cobertura de seguro básico de responsabilidad civil de la embarcación. El combustible está incluido en el precio del alquiler: la embarcación se entrega con el depósito lleno y el Arrendatario no necesita, ni debe, repostar en ningún momento durante el período de alquiler.
Electronic signature and rental contract:Firma electrónica y contrato de alquiler:
Once the booking is confirmed, Seaesta will send the Renter a rental contract via SignWell (electronic signature platform). The contract becomes binding only upon the Renter's electronic signature. By signing, the Renter confirms having read and accepted these Terms and Conditions, which form an integral part of the contract.
Una vez confirmada la reserva, Seaesta enviará al Arrendatario un contrato de alquiler a través de SignWell (plataforma de firma electrónica). El contrato será vinculante únicamente tras la firma electrónica del Arrendatario. Al firmar, el Arrendatario confirma haber leído y aceptado las presentes Condiciones, que forman parte integrante del contrato.
The following extras may be added to a booking at the prices listed below. All extras remain the property of Seaesta and are rented exclusively for the duration of the booked rental period. In the event of loss, damage or non-return of any extra, the corresponding amount will be deducted from the security deposit.
Los siguientes extras pueden añadirse a una reserva a los precios indicados. Todos los extras son propiedad de Seaesta y se alquilan exclusivamente durante el período de alquiler contratado. En caso de pérdida, daño o no devolución de cualquier extra, el importe correspondiente se deducirá del depósito de garantía.

The booking confirmation will be sent by email to the address provided. If no confirmation is received within 30 minutes, the Renter must contact Seaesta at info@seaestaboats.com before presenting themselves at Port Fòrum.
La confirmación de reserva se enviará por correo electrónico a la dirección facilitada. En caso de no recibir confirmación en el plazo de 30 minutos, el Arrendatario deberá contactar con Seaesta en info@seaestaboats.com antes de presentarse en Port Fòrum.
Cancellations made by the Renter are subject to the following charges, calculated on the total amount paid (VAT included):

To cancel, use the cancellation link included in your booking confirmation email from Seaesta. The timestamp of the cancellation request determines the applicable notice period. Seaesta will confirm the cancellation in writing within 24 business hours.
Para cancelar, utiliza el enlace de cancelación incluido en el email de confirmación de reserva de Seaesta. La fecha y hora de la solicitud de cancelación determinará la antelación aplicable. Seaesta confirmará la cancelación por escrito en el plazo de 24 horas hábiles.
Applicable refunds will be processed via Stripe within 10 business days, depending on the Renter's bank. Seaesta is not responsible for delays attributable to third-party financial institutions.
Los reembolsos correspondientes se procesarán a través de Stripe en el plazo de 10 días hábiles, dependiendo de la entidad bancaria del Arrendatario. Seaesta no es responsable de demoras imputables a entidades financieras terceras.
Cancellation due to weather or force majeure (Seaesta-initiated):Cancelación por causas meteorológicas o de fuerza mayor (iniciativa de Seaesta):
Seaesta reserves the right to cancel or reschedule a rental when any of the following conditions are forecasted or observed at departure time: significant wave height ≥ 0.5 m, wind speed equal to or greater than Force 5, or any official maritime warning, port restriction or meteorological alert issued by the competent authority (AEMET, Capitanía Marítima, Port Authority). The final decision regarding navigational safety remains at the sole discretion of Seaesta. If Seaesta cancels the departure under these circumstances, the Renter will be notified by email at least 1 hour before the scheduled departure time. The Renter may then choose between (a) a free date change, subject to availability, or (b) a full refund of the amount paid. Seaesta will not assume any additional costs or compensation (travel expenses, accommodation, etc.) arising from cancellation for these reasons.
Seaesta se reserva el derecho a cancelar o reprogramar un alquiler cuando se prevea o detecte, en el momento de la salida, alguna de las siguientes condiciones: altura significativa de olas ≥ 0,5 m, velocidad del viento igual o superior a Fuerza 5, o cualquier aviso marítimo oficial, restricción portuaria o alerta meteorológica emitida por la autoridad competente (AEMET, Capitanía Marítima, Autoridad Portuaria). La decisión final sobre la seguridad de la navegación queda a la entera discreción de Seaesta. Si Seaesta cancela la salida en estas circunstancias, el Arrendatario será notificado por correo electrónico con al menos 1 hora de antelación sobre la hora de salida prevista. El Arrendatario podrá entonces optar, a su elección, entre (a) el cambio de fecha sin coste adicional, sujeto a disponibilidad, o (b) el reembolso íntegro del importe abonado. Seaesta no asumirá ningún otro coste o indemnización adicional (gastos de desplazamiento, alojamiento, etc.) derivado de la cancelación por estas causas.
For bookings made through third-party platforms (GetYourGuide, Click&Boat, etc.), the cancellation policy of the relevant platform applies. Cancellations for those bookings must be processed through the respective platform directly.
Para las reservas realizadas a través de plataformas de terceros (GetYourGuide, Click&Boat, etc.), la política de cancelación aplicable será la de la plataforma correspondiente. Las cancelaciones de dichas reservas deben tramitarse directamente a través de la plataforma correspondiente.
Late arrival - no-show policy:Retraso - política de no presentación:
The Renter must be present at Port Fòrum and ready to board at the scheduled rental start time. If the Renter arrives more than 15 minutes after the booking start time, Seaesta reserves the right to cancel the booking and reallocate the vessel without issuing any refund.
El Arrendatario deberá estar presente en Port Fòrum y listo para embarcar a la hora de inicio estipulada en la reserva. Si el Arrendatario llega con más de 15 minutos de retraso sobre la hora de inicio reservada, Seaesta se reserva el derecho a cancelar la reserva y reasignar la embarcación sin emitir ningún reembolso.
Seaesta requires a €250 security deposit for every rental, managed via Stripe as a temporary hold (pre-authorisation) on the Renter's card. The deposit is requested no later than 72 hours before departure: for bookings made less than 72 hours in advance it is placed at checkout; for all other bookings it is placed automatically on the card used for payment, or through the link included in the confirmation email. Alternatively, the deposit may be left in cash at Port Fòrum on the day of the rental. By completing the booking, the Renter authorises Seaesta to place this hold on the card used for payment.
Seaesta requiere un depósito de garantía de 250 € para cada alquiler, gestionado a través de Stripe como retención temporal (pre-autorización) en la tarjeta del Arrendatario. El depósito se solicita como máximo 72 horas antes de la salida: en las reservas realizadas con menos de 72 horas de antelación se realiza en el momento del pago; en las demás se realiza automáticamente en la tarjeta utilizada para el pago o mediante el enlace incluido en el email de confirmación. Alternativamente, el depósito puede dejarse en efectivo en Port Fòrum el día del alquiler. Al completar la reserva, el Arrendatario autoriza a Seaesta a realizar esta retención en la tarjeta utilizada para el pago.
A pre-authorisation is a temporary hold on funds - the amount is never actually charged unless damage, a late return, or another chargeable event occurs (see list below). If no chargeable event occurs, the hold is released within 10 business days after the rental. The exact timing depends on the Renter's card network and issuing bank; no action is required from the Renter.
Una pre-autorización es una retención temporal de fondos - el importe no se carga realmente salvo que se produzcan daños, retraso en la devolución u otro supuesto de cargo (ver lista más abajo). Si no se produce ningún supuesto de cargo, la retención se libera en un plazo de 10 días hábiles tras el alquiler. El plazo exacto depende de la red de tarjetas y la entidad bancaria del Arrendatario; no se requiere ninguna acción por su parte.

If the automatic pre-authorisation fails, the Renter will be notified by email with a link to authorise the deposit with the same or another card, and must ensure their card has at least €250 available. If the hold cannot be placed before the rental date, Seaesta reserves the right to cancel the booking without refund of the rental fee.
Si la pre-autorización automática no es posible, el Arrendatario recibirá un email con un enlace para autorizar el depósito con la misma u otra tarjeta, y deberá asegurarse de que su tarjeta dispone de al menos 250 € disponibles. Si la retención no puede realizarse antes de la fecha del alquiler, Seaesta se reserva el derecho a cancelar la reserva sin reembolso del importe del alquiler.
Seaesta may retain all or part of the deposit in the following cases, without prior notice beyond notification at the end of the rental:

- Damage to the vessel, engine, equipment or accessories attributable to the Renter or passengers.Daños a la embarcación, motor, equipamiento o accesorios imputables al Arrendatario o a los pasajeros.
- Loss, theft or deterioration of on-board equipment.Pérdida, sustracción o deterioro de equipamiento a bordo.
- Late return of the vessel beyond the agreed time: charged per commenced hour at the hourly rate of the booked package, calculated on the standard package price.Retraso en la devolución de la embarcación respecto a la hora acordada: se cobra por cada hora iniciada a la tarifa horaria del paquete reservado, calculada sobre el precio estándar del paquete.
- Navigating outside the authorised navigation zone shown on the navigation map and in the briefing: fixed penalty of €100.Navegar fuera de la zona de navegación autorizada indicada en el mapa de navegación y en el briefing: penalización fija de 100 €.
- Extraordinary cleaning required due to misuse of the vessel (vomit, organic waste or excessive dirt): €30 fixed charge.Limpieza extraordinaria por mal uso de la embarcación (vómito, residuos orgánicos o suciedad excesiva): cargo fijo de 30 €.

Damage charge schedule. The following amounts apply to damage attributable to the Renter or passengers and will be deducted from the deposit:

- Damage to or breakage of the GPS unit: €50.Daño o rotura del GPS: 50 €.

- Any other damage to the vessel, its equipment or accessories: retention of the full deposit (€250).Cualquier otro daño a la embarcación, su equipamiento o accesorios: retención del depósito completo (250 €).
If the cost of damages or expenses exceeds the €250 deposit, the Renter is obliged to pay the difference immediately. Seaesta will document any damage with photographs before and after the rental.
Si el importe de los daños o gastos supera el depósito de 250 €, el Arrendatario queda obligado a abonar la diferencia de forma inmediata. Seaesta documentará cualquier daño con fotografías antes y después del alquiler.
Prior to the rental date, Seaesta will send the Renter a link to the pre-boarding form. Completion of this form is mandatory in order to board.
Con antelación a la fecha del alquiler, Seaesta remitirá al Arrendatario un enlace al formulario previo al embarque («pre-boarding form»). La cumplimentación de dicho formulario es obligatoria para poder embarcar.
The form collects the following for all persons on board (driver and passengers):

This information is collected to ensure identification of all persons on board, in compliance with applicable maritime safety requirements, and as an operational measure necessary for vessel insurance coverage and incident management. Data is processed in accordance with section 11 (Data Protection) and Seaesta's Privacy Policy.
Esta información se recoge para garantizar la identificación de todas las personas a bordo, en cumplimiento de los requisitos de seguridad marítima aplicables al conductor, y como medida operativa necesaria para la cobertura del seguro de la embarcación y la gestión de incidencias. Los datos se tratan de conformidad con lo dispuesto en la sección 11 (Protección de datos) y en la Política de Privacidad de Seaesta.
All persons on board must carry and present a valid original identity document (paper copies not accepted) at Port Fòrum at boarding. Seaesta staff will verify all identities before authorising departure. Absence of valid documentation or refusal to present it will prevent boarding, with no right to refund.
Todas las personas a bordo deberán llevar y presentar un documento de identidad original válido (no se admiten copias en papel) en Port Fòrum en el momento del embarque. El personal de Seaesta verificará la identidad de todos antes de autorizar la salida. La ausencia de documentación válida o la negativa a su presentación impedirá el embarque, sin derecho a reembolso.

Complete the form at least 24 hours before your departure to avoid check-in delays. The form can also be completed at Seaesta's facilities, though this may cause delays.

The vessel has mandatory third-party liability insurance in accordance with Spanish recreational navigation regulations. The Renter is responsible for knowing and complying with the applicable maritime traffic rules in the navigation area.
La embarcación cuenta con un seguro de responsabilidad civil obligatorio frente a terceros, conforme a la normativa española de navegación de recreo. El Arrendatario es responsable de conocer y cumplir las normas de tráfico marítimo aplicables en la zona de navegación.
Seaesta assumes no liability for accidents, personal injury, damage to third parties or damage to the Renter's or passengers' property occurring during the rental period when attributable to the Renter, passengers, or third parties unconnected to Seaesta.
Seaesta no asume responsabilidad alguna por accidentes, lesiones personales, daños a terceros o daños a bienes del Arrendatario o de los pasajeros, producidos durante el período de alquiler cuando sean imputables a conducta del Arrendatario, de los pasajeros, o de terceros ajenos a Seaesta.
The Renter assumes full responsibility for damage caused to the vessel or to third parties as a result of:
El Arrendatario asume íntegra responsabilidad por los daños causados a la embarcación o a terceros como consecuencia de:
- Breach of maritime traffic rules or instructions received in the briefing.Incumplimiento de las normas de tráfico marítimo o de las instrucciones recibidas en el briefing.
- Negligent or reckless driving or driving under the influence of capacity-impairing substances.Conducción negligente, imprudente o bajo los efectos de sustancias que alteren la capacidad.
- Exceeding the maximum permitted number of persons.Superación del número máximo de personas permitidas.
- Use of the vessel for unauthorised purposes.Uso de la embarcación para fines no autorizados.
- Operation by a person not registered on the boarding form.Conducción por persona no registrada en el formulario de embarque.
In no event shall Seaesta's liability for causes attributable to its own negligence exceed the total amount paid by the Renter for the rental.
En ningún caso la responsabilidad de Seaesta por causas imputables a su propia negligencia superará el importe total abonado por el Arrendatario en concepto de alquiler.
Seaesta is not responsible for personal belongings, electronic devices, documents or cash left on board. It is strongly recommended not to bring valuables during the rental. Seaesta does not offer a personal belongings storage service.
Seaesta no se hace responsable de objetos personales, equipos electrónicos, documentos o efectivo dejados a bordo. Se recomienda encarecidamente no llevar objetos de valor durante el alquiler. Seaesta no dispone de servicio de custodia de objetos personales.
In the event of a breakdown, incident or accident during the rental period, the Renter must immediately contact Seaesta's assistance service. Attempting to repair the vessel or engine without prior authorisation is strictly prohibited.
En caso de avería, incidencia o accidente durante el período de alquiler, el Arrendatario deberá contactar inmediatamente con el servicio de asistencia de Seaesta. Está estrictamente prohibido intentar reparar la embarcación o el motor sin autorización previa.
In the event of an accident or collision, the Renter must:
En caso de accidente o colisión, el Arrendatario deberá:
- Immediately notify Seaesta by phone (number provided in the booking confirmation and at the briefing).Notificar de inmediato a Seaesta por teléfono (número facilitado en la confirmación de reserva y en el briefing).
- If there is damage to third parties or other vessels: complete the nautical accident report and, if applicable, contact the relevant maritime authority (Maritime Rescue, Maritime Captaincy or Port Police).Si hay daños a terceros o a otras embarcaciones: cumplimentar el parte amistoso de accidente náutico y, si procede, contactar con la autoridad marítima competente (Salvamento Marítimo, Capitanía Marítima o Policía Portuaria).
- Not leave the scene of the accident until all necessary details have been collected.No abandonar el lugar del accidente hasta que se hayan recabado todos los datos necesarios.
- Not admit liability in writing to third parties without prior consultation with Seaesta.No admitir responsabilidad por escrito ante terceros sin consulta previa con Seaesta.
In the event of theft of the vessel or equipment, the Renter must file a report with the National Police within 24 hours and provide a copy to Seaesta.
En caso de robo de la embarcación o de equipamiento, el Arrendatario deberá presentar denuncia ante la Policía Nacional en el plazo máximo de 24 horas y entregar copia a Seaesta.
Any damage or loss attributable to the Renter will be assessed by Seaesta at market price, with prior photographic documentation. The Renter is obliged to bear the costs of repair or replacement regardless of insurance coverage, up to the limit of their liability.
Cualquier daño o pérdida imputable al Arrendatario será tasado por Seaesta al precio de mercado, previa documentación fotográfica. El Arrendatario queda obligado a asumir los costes de reparación o reposición con independencia de la cobertura del seguro, hasta el límite de su responsabilidad.

For bookings made through third-party platforms (GetYourGuide, Click&Boat or others), those platforms act as independent data controllers for the booking customer's data. En caso de reservas realizadas a través de plataformas de terceros (GetYourGuide, Click&Boat u otras), dichas plataformas actúan como responsables independientes del tratamiento de los datos del cliente prenotante. Seaesta actúa como responsable independiente únicamente respecto a los datos adicionales que recoge directamente (formulario de pasajeros, documentación de identidad).
These Terms are governed by Spanish law, in particular Royal Legislative Decree 1/2007 (Consumer Protection Act), Law 14/2014 of 24 July on Maritime Navigation, Royal Decree 875/2014 (Art. 10), and other applicable regulations governing the recreational nautical sector in Spain.
Las presentes Condiciones se rigen por la legislación española, en particular por el Real Decreto Legislativo 1/2007 (Ley General para la Defensa de los Consumidores y Usuarios), la Ley 14/2014, de 24 de julio, de Navegación Marítima, el Real Decreto 875/2014 sobre navegación sin titulación, y demás normativa aplicable al sector náutico de recreo en España.
For the resolution of any dispute arising from the interpretation or performance of these Terms, the parties submit to the Courts and Tribunals of Barcelona, expressly waiving any other jurisdiction that may apply, without prejudice to the mandatory jurisdiction that may correspond to the Renter as a consumer under consumer protection regulations.
Para la resolución de cualquier conflicto derivado de la interpretación o ejecución de las presentes Condiciones, las partes se someten a los Juzgados y Tribunales de Barcelona, con renuncia expresa a cualquier otro fuero que pudiera corresponderles, sin perjuicio del fuero imperativo que pudiera corresponder al Arrendatario como consumidor en virtud de la normativa de protección de consumidores y usuarios.
Before initiating any legal action, Seaesta recommends submitting the complaint in writing to info@seaestaboats.com, with a detailed description of the reason. Seaesta undertakes to respond within 15 business days and attempt an amicable resolution.
Antes de iniciar cualquier acción legal, Seaesta recomienda dirigir la reclamación por escrito a info@seaestaboats.com, con descripción detallada del motivo. Seaesta se compromete a dar respuesta en el plazo de 15 días hábiles e intentar una solución amistosa.
In the event of a consumer dispute, the Renter may use the EU online dispute resolution platform: ec.europa.eu/consumers/odr.

These General Terms and Conditions (hereinafter, "the Terms") govern the contractual relationship between Seaesta Seaempre S.L. (hereinafter, "Seaesta" or "the Lessor") and the natural or legal person completing a booking (hereinafter, "the Renter"), under which Seaesta grants the Renter temporary use of a recreational vessel, in accordance with Spanish Maritime Navigation Law 14/2014, Royal Legislative Decree 1/2007 (Consumer Protection Act) and other applicable regulations.

By completing the booking process, the Renter declares having read, understood and fully accepted these Terms, which are legally binding. Seaesta reserves the right to modify these Terms at any time; updated versions will be published on the website and will apply to bookings made after their publication.

These Terms apply both to bookings made directly on seaestaboats.com and to those made through third-party platforms (GetYourGuide, Click&Boat or others), with Seaesta's operational conditions being binding in all cases once the booking is confirmed.

The following requirements must be met to complete a rental with Seaesta:
Para poder formalizar un alquiler con Seaesta, deben cumplirse los siguientes requisitos:
- The Renter must be at least 18 years old and have full legal capacity to contract.El Arrendatario debe ser mayor de 18 años y tener plena capacidad jurídica para contratar.
- The designated driver(s) must be at least 18 years old and present a valid official identity document (national ID, NIE or passport). The driver's identity must be verified before the rental begins, both via the pre-boarding form and by presenting the original document at Port Fòrum.El conductor o conductores designados deben ser mayores de 18 años y presentar un documento de identidad oficial válido en vigor (DNI, NIE o pasaporte). Se deberá acreditar la identidad del conductor antes del inicio del alquiler, tanto mediante el formulario previo al embarque como con la presentación del documento original en Port Fòrum.
- The Barqa Q17 vessels (4.99 m, 15 HP Suzuki engine) do not require a nautical licence, in accordance with Royal Decree 875/2014. However, the driver must complete and pass the mandatory safety briefing before departure.Las embarcaciones Barqa Q17 (4,99 m, motor 15 CV Suzuki) no requieren titulación náutica, de conformidad con el Real Decreto 875/2014 (Art. 10) sobre titulaciones náuticas. No obstante, el conductor deberá realizar y superar el briefing de seguridad obligatorio antes de zarpar.
- The maximum capacity is 5 persons on board, including driver(s) and passengers. Exceeding this limit constitutes a serious breach and grounds for immediate termination of the contract.La capacidad máxima es de 5 personas a bordo, incluyendo conductor(es) y pasajeros. Superar este límite constituye infracción grave y motivo de resolución inmediata del contrato.
- Vessels are collected and returned at Seaesta's facilities at Port Fòrum, Barcelona. Return at any other point is not permitted without prior written agreement.Las embarcaciones se recogen y devuelven en las instalaciones de Seaesta en Port Fòrum, Barcelona. No se permite la devolución en otro punto salvo acuerdo escrito previo.
- Only persons registered on the boarding form may use the vessel. Assignment, sub-letting or use by unregistered persons is expressly prohibited.Únicamente podrán usar la embarcación las personas registradas en el formulario de embarque. Queda expresamente prohibida la cesión, subarriendo o uso por personas no registradas.
Departures begin from 07:30. The specific start and end times for each rental are those indicated in the booking confirmation. The Renter must return the vessel by the booked end time. Late returns without prior notice will be charged at the applicable rate per commenced hour.
Las salidas comienzan a partir de las 07:30 h. Los horarios concretos de inicio y fin de cada alquiler son los indicados en la confirmación de reserva. El Arrendatario debe devolver la embarcación al finalizar su franja horaria reservada. Los retrasos en la devolución sin comunicación previa serán facturados a la tarifa vigente por fracción de hora completa iniciada.
The Renter receives the vessel in correct working order, clean and with a full fuel tank. Any deficiency observed at handover must be reported to Seaesta staff before departure and noted in writing.
El Arrendatario recibe la embarcación en correcto estado de funcionamiento, limpia y con el depósito de combustible lleno. Cualquier deficiencia observada en el momento de la entrega deberá comunicarse al personal de Seaesta antes de zarpar y quedar reflejada por escrito.
Minors on board are permitted only under the following conditions:
Se permite la presencia de menores de edad a bordo únicamente bajo las siguientes condiciones:
- Minors must be accompanied at all times by their parent or legal guardian, who will be responsible for their safety throughout the rental.Los menores deben ir acompañados en todo momento por su padre, madre o tutor legal, quien será responsable de su seguridad durante toda la duración del alquiler.
- The parent or legal guardian who signs the rental contract and boarding form assumes full responsibility for the minors in their care, including compliance with safety rules and correct use of life jackets.El padre, madre o tutor legal que firme el contrato de alquiler y el formulario previo al embarque asume plena responsabilidad por los menores a su cargo, incluyendo el cumplimiento de las normas de seguridad y el uso correcto de los chalecos salvavidas.
- Seaesta reserves the right to refuse boarding if, in the judgement of staff present, the safety of minors on board cannot be guaranteed (adverse weather, group behaviour, excessive number of persons, etc.).Seaesta se reserva el derecho de denegar el embarque si, a criterio del personal presente, la seguridad de los menores a bordo no puede garantizarse (condiciones meteorológicas adversas, comportamiento del grupo, número excesivo de personas, etc.).
- Children under 14 must wear an approved life jacket at all times while the vessel is in motion. Seaesta has children's life jackets available upon prior request.Los menores de 14 años deben llevar chaleco salvavidas homologado en todo momento mientras la embarcación esté en movimiento. Seaesta dispone de chalecos infantiles bajo solicitud previa.
- For capacity purposes, minors count as a full person. The 5-person limit includes minors without exception.A efectos del cómputo de capacidad, los menores cuentan como una persona completa. El límite de 5 personas incluye a los menores sin excepción.

If travelling with minors, please mention this when booking. Seaesta will prepare appropriate safety equipment (children's life jackets) and the briefing will include specific instructions.

The Renter undertakes to use the vessel diligently and responsibly, respecting maritime traffic regulations at all times. The following are expressly prohibited:
El Arrendatario se compromete a utilizar la embarcación de forma diligente y responsable, respetando en todo momento la normativa de tráfico marítimo vigente. Queda expresamente prohibido:
- Operating under the influence of alcohol, drugs or any other substance that impairs consciousness, reflexes or responsiveness, or navigating in a state of drowsiness or fatigue that poses a risk to the driver, passengers or third parties.Navegar bajo los efectos del alcohol, drogas u otras sustancias que alteren el estado de consciencia o los reflejos, o en estados de somnolencia o fatiga que pongan en peligro la integridad propia, de los pasajeros o de terceros.
- Negligent or reckless navigation that endangers the driver, passengers or third parties.Conducir de forma negligente, temeraria o que ponga en peligro la integridad propia, de los pasajeros o de terceros.
- Exceeding the authorised navigation zones indicated in the briefing, going beyond established limits, or navigating in adverse weather conditions or during an active alert.Superar las zonas de navegación autorizadas indicadas en el briefing, alejarse más allá de los límites establecidos o navegar en condiciones meteorológicas adversas o con alerta activa.
- Using the vessel to push or tow other vehicles, practising high-risk sports not authorised by Seaesta, or participating in any race or competition.Usar la embarcación para empujar, remolcar otros vehículos, practicar actividades deportivas de alto riesgo no autorizadas por Seaesta, o participar en cualquier tipo de prueba o competición.
- Modifying, tampering with or attempting to repair the vessel, engine or any equipment without Seaesta's express authorisation.Modificar, manipular o intentar reparar la embarcación, el motor o cualquier equipo sin autorización expresa de Seaesta.
- Mooring the vessel in an undesignated location without prior notice to Seaesta.Amarrar la embarcación en un lugar no designado sin comunicarlo previamente a Seaesta.
- Assigning, sub-letting or allowing use of the vessel by persons not registered on the boarding form.Ceder, subarrendar o permitir el uso de la embarcación a personas no registradas en el formulario de embarque.
- Exceeding the maximum capacity of 5 persons on board.Superar la capacidad máxima de 5 personas a bordo.
- The possession or use of illegal substances, narcotics, weapons or any item prohibited under Spanish law on board is strictly forbidden for all persons, regardless of their role.Queda estrictamente prohibido para todas las personas a bordo, con independencia de su función, portar o consumir sustancias ilegales, estupefacientes, armas o cualquier objeto prohibido por la legislación española.
Consequences of breach:Consecuencias del incumplimiento:
Breach of any of the above prohibitions may result in immediate termination of the contract without refund, full retention of the security deposit, and the Renter's civil liability for all damages caused, including any resulting administrative penalties.

Seaesta staff will conduct a mandatory safety briefing before each departure. The Renter will confirm their understanding of the instructions received by signing the boarding form. Departure will not be authorised without completion and signature of the briefing.

Pets are welcome on board. The Renter is responsible for keeping them safe and under control at all times and for cleaning up after them.

Under Spanish maritime law (Real Decreto 875/2014), vessels of this category are not permitted to navigate after sunset. Seaesta sets all package end times to ensure return to port before sunset. The Renter must respect the booked end time. Any fines or sanctions imposed by maritime or port authorities due to navigation after sunset are the exclusive responsibility of the Renter.
Conforme a la legislación marítima española (Real Decreto 875/2014), las embarcaciones de esta categoría no están autorizadas a navegar después del ocaso. Seaesta establece los horarios de fin de cada paquete para garantizar el regreso al puerto antes del ocaso. El Arrendatario debe respetar la hora de finalización reservada. Cualquier multa o sanción impuesta por las autoridades marítimas o portuarias por navegar después del ocaso es responsabilidad exclusiva del Arrendatario.
Bookings are made exclusively online through seaestaboats.com or authorised distribution platforms (GetYourGuide, Click&Boat or others listed on the website), subject to real-time availability.

All published prices include applicable VAT (21%) and basic third-party liability insurance for the vessel. Fuel is included in the rental price: the vessel is handed over with a full tank and the Renter must not refuel at any point during the rental period.

Once the booking is confirmed, Seaesta will send the Renter a rental contract via SignWell (electronic signature platform). The contract becomes binding only upon the Renter's electronic signature. By signing, the Renter confirms having read and accepted these Terms and Conditions, which form an integral part of the contract.

The following extras may be added to a booking at the prices listed below. All extras remain the property of Seaesta and are rented exclusively for the duration of the booked rental period. In the event of loss, damage or non-return of any extra, the corresponding amount will be deducted from the security deposit.

To cancel, use the cancellation link included in your booking confirmation email from Seaesta. The timestamp of the cancellation request determines the applicable notice period. Seaesta will confirm the cancellation in writing within 24 business hours.

Cancellation due to weather or force majeure (Seaesta-initiated):Cancelación por causas meteorológicas o de fuerza mayor (iniciativa de Seaesta):
Seaesta reserves the right to cancel or reschedule a rental when any of the following conditions are forecasted or observed at departure time: significant wave height ≥ 0.5 m, wind speed equal to or greater than Force 5, or any official maritime warning, port restriction or meteorological alert issued by the competent authority (AEMET, Capitanía Marítima, Port Authority). The final decision regarding navigational safety remains at the sole discretion of Seaesta. If Seaesta cancels the departure under these circumstances, the Renter will be notified by email at least 1 hour before the scheduled departure time. The Renter may then choose between (a) a free date change, subject to availability, or (b) a full refund of the amount paid. Seaesta will not assume any additional costs or compensation (travel expenses, accommodation, etc.) arising from cancellation for these reasons.
Seaesta se reserva el derecho a cancelar o reprogramar un alquiler cuando se prevea o detecte, en el momento de la salida, alguna de las siguientes condiciones: altura significativa de olas ≥ 0,5 m, velocidad del viento igual o superior a Fuerza 5, o cualquier aviso marítimo oficial, restricción portuaria o alerta meteorológica emitida por la autoridad competente (AEMET, Capitanía Marítima, Autoridad Portuaria). La decisión final sobre la seguridad de la navegación queda a la entera discreción de Seaesta. Si Seaesta cancela la salida en estas circunstancias, el Arrendatario será notificado por correo electrónico con al menos 1 hora de antelación sobre la hora de salida prevista. El Arrendatario podrá entonces optar, a su elección, entre (a) el cambio de fecha sin coste adicional, sujeto a disponibilidad, o (b) el reembolso íntegro del importe abonado. Seaesta no asumirá ningún otro coste o indemnización adicional (gastos de desplazamiento, alojamiento, etc.) derivado de la cancelación por estas causas.
For bookings made through third-party platforms (GetYourGuide, Click&Boat, etc.), the cancellation policy of the relevant platform applies. Cancellations for those bookings must be processed through the respective platform directly.

The Renter must be present at Port Fòrum and ready to board at the scheduled rental start time. If the Renter arrives more than 15 minutes after the booking start time, Seaesta reserves the right to cancel the booking and reallocate the vessel without issuing any refund.
El Arrendatario deberá estar presente en Port Fòrum y listo para embarcar a la hora de inicio estipulada en la reserva. Si el Arrendatario llega con más de 15 minutos de retraso sobre la hora de inicio reservada, Seaesta se reserva el derecho a cancelar la reserva y reasignar la embarcación sin emitir ningún reembolso.
Seaesta requires a €250 security deposit, managed via Stripe. The deposit is not charged at the time of booking. Seaesta will attempt to pre-authorise the €250 hold on the Renter's card at the time of checkout. If unsuccessful, a further automatic attempt will be made up to 24 hours before the rental date. By completing the booking, the Renter authorises Seaesta to place this hold on the card used for payment.

A pre-authorisation is a temporary hold on funds - the amount is never actually charged unless damage, a late return, or another chargeable event occurs (see list below). If no chargeable event occurs, the hold is released within 10 business days after the rental. The exact timing depends on the Renter's card network and issuing bank; no action is required from the Renter.

The pre-authorisation is attempted at checkout. If unsuccessful, one further automatic attempt will be made up to 24 hours before the rental date. The Renter will be notified by email after a failed attempt and must ensure their card has at least €250 available. If the hold cannot be placed before the rental date, Seaesta reserves the right to cancel the booking without refund of the rental fee.

Seaesta may retain all or part of the deposit in the following cases, without prior notice beyond notification at the end of the rental:

- Extraordinary cleaning required due to misuse of the vessel (vomit, organic waste or excessive dirt): €30 fixed charge.Limpieza extraordinaria por mal uso de la embarcación (vómito, residuos orgánicos o suciedad excesiva): cargo fijo de 30 €.
- Fines, penalties or administrative fees imposed by maritime or port authorities during the rental period attributable to the Renter.Multas, sanciones o tasas administrativas impuestas por autoridades marítimas o portuarias durante el período de alquiler, imputables al Arrendatario.
Damage charge schedule. The following amounts apply to damage attributable to the Renter or passengers and will be deducted from the deposit:

If the cost of damages or expenses exceeds the €250 deposit, the Renter is obliged to pay the difference immediately. Seaesta will document any damage with photographs before and after the rental.
Si el importe de los daños o gastos supera el depósito de 250 €, el Arrendatario queda obligado a abonar la diferencia de forma inmediata. Seaesta documentará cualquier daño con fotografías antes y después del alquiler.
Prior to the rental date, Seaesta will send the Renter a link to the pre-boarding form. Completion of this form is mandatory in order to board.
Con antelación a la fecha del alquiler, Seaesta remitirá al Arrendatario un enlace al formulario previo al embarque («pre-boarding form»). La cumplimentación de dicho formulario es obligatoria para poder embarcar.

This information is collected to ensure identification of all persons on board, in compliance with applicable maritime safety requirements, and as an operational measure necessary for vessel insurance coverage and incident management. Data is processed in accordance with section 11 (Data Protection) and Seaesta's Privacy Policy.

All persons on board must carry and present a valid original identity document (paper copies not accepted) at Port Fòrum at boarding. Seaesta staff will verify all identities before authorising departure. Absence of valid documentation or refusal to present it will prevent boarding, with no right to refund.

Complete the form at least 24 hours before your departure to avoid check-in delays. The form can also be completed at Seaesta's facilities, though this may cause delays.

The vessel has mandatory third-party liability insurance in accordance with Spanish recreational navigation regulations. The Renter is responsible for knowing and complying with the applicable maritime traffic rules in the navigation area.
La embarcación cuenta con un seguro de responsabilidad civil obligatorio frente a terceros, conforme a la normativa española de navegación de recreo. El Arrendatario es responsable de conocer y cumplir las normas de tráfico marítimo aplicables en la zona de navegación.
Seaesta assumes no liability for accidents, personal injury, damage to third parties or damage to the Renter's or passengers' property occurring during the rental period when attributable to the Renter, passengers, or third parties unconnected to Seaesta.
Seaesta no asume responsabilidad alguna por accidentes, lesiones personales, daños a terceros o daños a bienes del Arrendatario o de los pasajeros, producidos durante el período de alquiler cuando sean imputables a conducta del Arrendatario, de los pasajeros, o de terceros ajenos a Seaesta.
The Renter assumes full responsibility for damage caused to the vessel or to third parties as a result of:

- Breach of maritime traffic rules or instructions received in the briefing.Incumplimiento de las normas de tráfico marítimo o de las instrucciones recibidas en el briefing.
- Negligent or reckless driving or driving under the influence of capacity-impairing substances.Conducción negligente, imprudente o bajo los efectos de sustancias que alteren la capacidad.
- Exceeding the maximum permitted number of persons.Superación del número máximo de personas permitidas.
- Use of the vessel for unauthorised purposes.Uso de la embarcación para fines no autorizados.
- Operation by a person not registered on the boarding form.Conducción por persona no registrada en el formulario de embarque.
In no event shall Seaesta's liability for causes attributable to its own negligence exceed the total amount paid by the Renter for the rental.
En ningún caso la responsabilidad de Seaesta por causas imputables a su propia negligencia superará el importe total abonado por el Arrendatario en concepto de alquiler.
Seaesta is not responsible for personal belongings, electronic devices, documents or cash left on board. It is strongly recommended not to bring valuables during the rental. Seaesta does not offer a personal belongings storage service.
Seaesta no se hace responsable de objetos personales, equipos electrónicos, documentos o efectivo dejados a bordo. Se recomienda encarecidamente no llevar objetos de valor durante el alquiler. Seaesta no dispone de servicio de custodia de objetos personales.
In the event of a breakdown, incident or accident during the rental period, the Renter must immediately contact Seaesta's assistance service. Attempting to repair the vessel or engine without prior authorisation is strictly prohibited.
En caso de avería, incidencia o accidente durante el período de alquiler, el Arrendatario deberá contactar inmediatamente con el servicio de asistencia de Seaesta. Está estrictamente prohibido intentar reparar la embarcación o el motor sin autorización previa.
In the event of an accident or collision, the Renter must:

- Immediately notify Seaesta by phone (number provided in the booking confirmation and at the briefing).Notificar de inmediato a Seaesta por teléfono (número facilitado en la confirmación de reserva y en el briefing).

In the event of theft of the vessel or equipment, the Renter must file a report with the National Police within 24 hours and provide a copy to Seaesta.
En caso de robo de la embarcación o de equipamiento, el Arrendatario deberá presentar denuncia ante la Policía Nacional en el plazo máximo de 24 horas y entregar copia a Seaesta.
Any damage or loss attributable to the Renter will be assessed by Seaesta at market price, with prior photographic documentation. The Renter is obliged to bear the costs of repair or replacement regardless of insurance coverage, up to the limit of their liability.
Cualquier daño o pérdida imputable al Arrendatario será tasado por Seaesta al precio de mercado, previa documentación fotográfica. El Arrendatario queda obligado a asumir los costes de reparación o reposición con independencia de la cobertura del seguro, hasta el límite de su responsabilidad.

For bookings made through third-party platforms (GetYourGuide, Click&Boat or others), those platforms act as independent data controllers for the booking customer's data. Seaesta acts as an independent controller only in respect of the additional data it collects directly (passenger form, identity documentation).
En caso de reservas realizadas a través de plataformas de terceros (GetYourGuide, Click&Boat u otras), dichas plataformas actúan como responsables independientes del tratamiento de los datos del cliente prenotante. Seaesta actúa como responsable independiente únicamente respecto a los datos adicionales que recoge directamente (formulario de pasajeros, documentación de identidad).
These Terms are governed by Spanish law, in particular Royal Legislative Decree 1/2007 (Consumer Protection Act), Law 14/2014 of 24 July on Maritime Navigation, Royal Decree 875/2014 (Art. 10), and other applicable regulations governing the recreational nautical sector in Spain.
Las presentes Condiciones se rigen por la legislación española, en particular por el Real Decreto Legislativo 1/2007 (Ley General para la Defensa de los Consumidores y Usuarios), la Ley 14/2014, de 24 de julio, de Navegación Marítima, el Real Decreto 875/2014 sobre navegación sin titulación, y demás normativa aplicable al sector náutico de recreo en España.
For the resolution of any dispute arising from the interpretation or performance of these Terms, the parties submit to the Courts and Tribunals of Barcelona, expressly waiving any other jurisdiction that may apply, without prejudice to the mandatory jurisdiction that may correspond to the Renter as a consumer under consumer protection regulations.
Para la resolución de cualquier conflicto derivado de la interpretación o ejecución de las presentes Condiciones, las partes se someten a los Juzgados y Tribunales de Barcelona, con renuncia expresa a cualquier otro fuero que pudiera corresponderles, sin perjuicio del fuero imperativo que pudiera corresponder al Arrendatario como consumidor en virtud de la normativa de protección de consumidores y usuarios.
Before initiating any legal action, Seaesta recommends submitting the complaint in writing to info@seaestaboats.com, with a detailed description of the reason. Seaesta undertakes to respond within 15 business days and attempt an amicable resolution.
Antes de iniciar cualquier acción legal, Seaesta recomienda dirigir la reclamación por escrito a info@seaestaboats.com, con descripción detallada del motivo. Seaesta se compromete a dar respuesta en el plazo de 15 días hábiles e intentar una solución amistosa.
In the event of a consumer dispute, the Renter may use the EU online dispute resolution platform: ec.europa.eu/consumers/odr.
En caso de litigio con consumidores, el Arrendatario podrá acudir a la plataforma europea de resolución de litigios en línea: ec.europa.eu/consumers/odr.
